(Ed: Hat tip to Jeremy David for reporting this on Facebook)
United States District Court Judge Judith Levy has struck the LNC’s filing for a preliminary injunction against the Michigan Libertarian Party (Michael Saliba, Chair). The LNC has until Friday the 16th to fix their filing and refile. An image of the complete Order Striking Plaintiff’s Motion for Preliminary Injunction is available here or can be found on Facebook.
The LNC did indeed find local counsel, adequately fix the filing, and refile. A hearing is scheduled for August 23, 2023. (Hat tip to Jonathan M. Jacobs of the hearing date.)

Faults identified by the court with the original filing included:
Missing Statement of Concurrence
Wrong Font or Format
Missing information e.g, controlling authority
Exhibits do not comply with rules
Failed to redact information required to be redacted
Noncompliance with rule on filing an item under seal
Failure to satisfy local counsel requirement

The Libertarian Party of Michigan (Mr. Saliba, Chair) has now filed a response to the request for a preliminary injunction. You can read it at

In short: The law doesn’t work that way. They haven’t disaffiliated us yet; they need a 3/4 vote. Our use of the name will not lead to confusion.
I anticipate covering the next court action when it occurs.
Mr. Phillies,
Would you mind covering that the issues in the first filing were corrected and that a new filing was filed on the 15th?
Hi JJ – George said that in the article.
Actually, they have to 6/16 to fix the problems.
We do not have an opinion on this question, which is disputed.
Did they even try to hire an attorney? The only local attorneys that might be stupid enough to take this on have probably all gone to Florida to work for you know who.
This sort of reminds me of the old Monty Python skit, where someone bought a cat license from the man in the cat detector van, and the other person looking at it commented that it was a dog license with the word dog crossed out and cat written in — in crayon.
Sorry, but this is comical and sad. To think that the “party of principle” could become so unprincipled…
You should specify Salba’s party is the fake one.
