LNC Chair Nekhaila Faces Censure Motion from Region 1 Representative

Libertarian National Committee Region 1 Representative Andrew Chadderdon has introduced a motion to censure LNC Chair Steven Nekhaila, citing alleged violations of fiduciary duty, interference with access to legal counsel, and unauthorized disclosure of sensitive information.

Chadderdon published his motion on the LNC’s public Business List on Saturday, August 30, noticing it for the agenda for the organization’s upcoming special meeting on September 7. The meeting will also address a previously noticed censure motion, several subcommittee appointments, and a proposal to monetize public emails to the full LNC exceeding 150 characters.

The censure filing references an August 10 proposal to amend the LNC Policy Manual that would have restricted direct communication with LNC Counsel to the chair and executive director. Although the amendment cited by Chadderdon was not adopted, he alleges that Nekhaila subsequently attempted to enforce similar restrictions unilaterally, obstructing member inquiries into potential misconduct and withholding legal updates from the full committee.

Chadderdon’s motion further accuses Nekhaila of disclosing sensitive legal strategy to an unauthorized individual and acting in a manner contrary to the LNC’s stated interests. It cites multiple provisions of the Policy Manual as grounds for censure, including sections on duty of care, good faith, and obedience.

“Mr. Nekhaila has acted outside of his authority in a manner that is unbecoming of a professional organization,” the motion reads.

In a response posted Sunday, August 31, Nekhaila rejected the allegations as inaccurate and factional, stating they “misstate both the facts and the Policy Manual.” He plans to give a complete rebuttal to the accusations during the meeting.

“Out of respect to the body and process I will reserve a full response for the Sep 7th meeting,” Nekhaila continued. “I am confident the record will speak for itself.”

The motion will require a majority vote of the LNC to pass. It is the second censure motion scheduled for the September 7 agenda, following Nekhaila’s notice last month of a motion to censure Region 1 Alternate Austin Martin.

    Is Chadderdon saying he has questions that have not been addressed by legal counsel AND the LNC is continually considering legal strategy without input from legal counsel except for the brief period of time during LNC meetings?

    If that’s the case, I can see the problem. I also think that rival censures is a strange way to get to a resolution to this problem. That’s a bigger problem that’s clear overtaking their conversation.

    Harlos was indeed part of the toxic culture. That is obvious. She just wasn’t the only one.

    Maybe everyone is right: censure everyone on the LNC.

    Or maybe, just maybe, only one person was right, the one person who was roundly criticized, attacked, castigated, and suspended twice for pointing it all out: Caryn Ann Harlos.

    It has become obvious that the toxicity wasn’t her.

    But nobody will ever apologize for being wrong, or to her, for their behavior.
