The West Virginia Record reports attorney Joseph Wallace, “winner of a constitutional contest on behalf of the Constitution Party, seeks $275 an hour for his services. Wallace persuaded U.S. District Judge John Preston Bailey to declare that under the U.S. Constitution, the West Virginia Legislature can’t prohibit soliciting in state parks. … A prevailing party in a constitutional claim can claim attorney’s fees from the loser, and Bailey asked Wallace to submit a bill. Wallace billed 79.8 hours at $275 an hour, for a total of $21,945.” Rutherford Institute attorney Douglas McKusick, who also served on behalf of the Constitution Party in the case, “billed 72.3 hours at $200 to $250.” West Virginia Division of Natural Resources Director Frank Jezioro, “the loser in the contest, argues that Wallace doesn’t deserve $275.”

I thought the state was appealing this decision, in which case it wouldn’t be appropriate for the court to decide attorneys fees at this point.
The newspaper story is somewhat misleading about the law on attorneys fees. When someone sues a state government in federal court for violating civil rights (including voting rights), and that someone wins, then the state must pay attorneys fees. But if someone sues a state in federal court over civil rights violations and loses, it doesn’t follow that the person or group who filed the lawsuit must pay attorneys fees to the state.

That’s a good start.
I hope that the LPWV folks are preparing a news release stating something to the effect that the tax payers shouldn’t be the recipients of this bill, and wouldn’t be had Jezioro not been afflicted with an arrogant, condescending attitude toward free elections.
