At least five minor party legislative candidates were elected on November 4. The Progressive Party of Vermont re-elected David Zuckerman, Sandy Haas, Susan Davis, and Sarah Edwards.

With 96% of Georgia’s precincts reporting, the U.S. Senate results are: Chambliss (R) 49.9%, Martin (D) 46.7%, Buckley (Libt.) 3.4%. Georgia is the only state in which no one can be deemed elected to any statewide post (other than president) without 50% of the vote (also, Vermont has that rule for Governor, and Louisiana has it for state office, but not federal office).

No federal court has ever struck down any state’s law, on how a party remains on the ballot. However, the Arkansas Green Party, and the Pennsylvania Libertarian Party, are in an excellent position to file such lawsuits and win them.
