I have been looking for an account of last Saturday’s Convention of the Constitution Party faction of the California AIP, and lo and behold I found this at the Constitution Party website. Imagine that. Sorry this is a tad late, but here it is. The first paragraph is obviously referring to a photo that is not attached to the article.
Chelene Nightingale and Constitution Party National Executive Committee member, Bill Lussenheide, confer at recent American Independent State Convention Banquet in Ontario, CA. In foreground is two-time AIP chairman and current Secretary of State candidate, Merton Short, along with other Northern California AIP leaders, Jean Westphal and Judy Short. Seated behind Chelene are long time Los Angeles County leader Ted Nicholoff and original 1968 AIP member, Robert Geisweit. Veteran American Independent Party leaders were much in evidence at the meetings and the banquet along with many, many new faces attracted by the great California ticket headed by Chelene Nightingale. At the banquet, awards for lifetime (AIP) achievement were presented to Nancy Shearer Chiasson (the daughter of AIP founders Bill and Eileen Shearer), Jim Griffin, Merton Short, Larry Breazeale and Gary Odom.
Dr. Don Grundmann was elected the new Chairman of the American Independent Party which voted unanimously to retain its affiliation with the national Constitution Party. Plans were made to expand the outreach of the AIP/CP in California. The State Committee also discussed plans to continue the fight to regain recognition by the state of California as the official American Independent Party organization, which was erroneously awarded to a tiny rouge group with no historical roots or involvement with the American Independent Party in 2008.
The highlight of the very successful weekend event was the banquet address by California Gubernatorial candidate, Chelene Nightingale. A long time party veteran said that it was one of the finest and most moving political speeches that he had heard in his 40 years of political involvement. During the Saturday Convention, members also heard fine addresses from Veteran’s Home advocate, Robert Rosebrock, California Coalition for Immigration Reform leader, Barbara Coe and Ballot Access News publisher, Richard Winger, who spoke on Proposition 14.
The weekend event was an artistic and financial success for both the state party and for the Nightingale for Governor Campaign. Many thanks to those who worked so hard to make this event a great success, including Bill and Terri Lussenheide and the worlds greatest state treasurer, Charles Deemer. Thanks too, go out to Dani Rascon, Chelene Nightingale’s dynamic campaign manager for her great help in promoting this event.

voted to affiliate with the America’s Independent Party.
There is no current connection between the American Independent Party and the Constitution Party. I do note a
connection of the date of June 27, 2008. While Don Grundmann claimed he on June 27, 2008 was electing himself (all by himself) as a bogus “Vice Chairman” of the AIP in Los Angeles, CA , the others on the State Central Committee voted to affiliate with the America’s Independent

I have no idea what you mean by “survey” here. The only listing on the front page for the AIP is in the links, and it points to the Keyes group. Individual authors, not IPR, decide on classifying each particular article. For example. this one is classified under CP because it deals with that faction. It’s possible that Cody or someone classified all AIP articles under CP, including the Keyes group ones. That is not a classification on the part of IPR per se.
I stand by that statement.

Response – The AIP never disaffilated from the Constitution Party. No true vote was taken to accomplish this. That I know of, Nightingale has not voluntarily posted her campaign disclosure. I went to the Sceretary of State and requested copies of what they had and posted them on Public Document Distributors.com.

There are more than these three laws governing the convention and organizational meeting of the
American Independent Party.
First, why Sacramento County? William Shearer wanted on the Friday before and/or
Monday after the SCC meeting to do lobbying
of the California State Legislature on current
issues. It was his idea to have the conventions in
Sacramento.
Jim King tried to claim that the 2006 convention
that Ernie Vance set-up in Rancho Cordova was
outside of the County Seat of Sacramento County in his case of KING v. BOWEN in 2008.
King tried to claim that the word Sacrammento was a term of art limited to the city limits of the
City of Sacramento, and therefore having a
convention in Rancho Cordova (City) voided out
the 2006 convention so Chairman Noonan was
not the Chairman of the AIP, because he Jim King was the Chairman of the AIP having been
“elected” in the City of Los Angeles.
Prior to the creation of the City of Rancho Cordova, Rancho Cordova was one of the 25
communities of Sacramento County. The word
Sacramento related to the County of Sacramento and not just the City.
Jim King’s legal game did not work to void out the 2006 convention in Rancho Cordova. Judge
Kenny did not buy into that limited meaning of
Sacramento. For one thing the city of Sacramento is not divided into communities. Only Sacramento County is divied into communities (25 total), see Section 7620 (word
“community”).

The verbiage is actually quite different depending on the party. Even the Dems and Repubs differ. The rules for some are quite sparse. Some are quite specific. I highly suspect that the Election Code is simply incorporating the internal rules the parties made for themselves. I suspect the parties submitted these themselves. I can’t imagine a bunch of legislators and bureaucrats sitting around devising one set of rules for one minor party and another set of rules for another.
So if this is simply an incorporation of the internal rules of the party, the important question would be “What was the intent of those who made the rules?”
The rules actually seem to internally conflict.
7570 The state convention shall meet biennially, at a location designated by the state central committee, at 10 a.m. on a Saturday following the direct primary election, but in no event later than August 15.
7608 Each delegate to the state convention shall send a notice by mail to each person whom he or she has appointed as a member of this
committee, that will inform him or her that:
(a) He or she is a member of the committee.
(b) The committee will meet in Sacramento and the date of the meeting.
(c) The meeting may be attended either in person or by proxy.
(d) The proxy shall be in writing, and signed by the member under penalty of perjury.
7820 The committee shall convene in the same community where the state convention is held, at 10 a.m. on the Sunday following the state convention.
So the state convention can be in any city as determined by the state central committee (7570). The state central committee meets in the same “community” as the convention (7820). (Ah! Now I see why MS is making an issue of the word community.) But the meeting shall be in Sacramento (7608).
My hunch is that 7608 is language regarding the initial meeting of the AIP after official recognition or is just an errant entry in what the AIP submitted to the election officials.
It makes no sense to say that the meeting can be held in whatever city the committee decides, but that city must be forever and always Sacramento. If this is a major part of what MS and crew are hanging their hats on to establish the legitimacy of their faction, then that is really sad.

You are in error. The process with the SOS in CA is very restrictive even after Prop. 14.
There are three basic laws we start with.
First, CA Elections Code Section 7608 states in part:
“Each delegate to the state convention shall send a notice by mail to each person whom he or
she has appointed as a member of this committee

…
(b) the committee will meet in Sacramento and the date of the meeting.”
By “committee” it means the State Central Committee of the American Independent Party.
By “Sacramento” it means the “County of Sacramento”, because the county seat is not divided into communities. Only county in the
State of California that divides itself totally into
communites is the County of Sacramento, which
has 25 communites.
Second, CA Election Code Section 7620 states that:
“The committee shall convene in the same community where the state convention is held,
at 10 a.m. on the Sunday following the state convention.”
Third, CA Election Code Section 7570 states that:
“The state convention shall meet biennially, at a

As you can see from the above all the State Central Committee can do is pick locations for

law. It was past by the legislature and signed into
law the governor to become law.
It is also a requirement in 56 of the 58 counties
that the organizational meetings of the County
Central Committees meet in a Courthouse in its
County Seat. The two current exceptions are
Los Angeles County and Alpine County.
The California Code is very restrictive on the
State Central Committee.
I held AIP offices, since 2004. Jim King was the

If they would like to send me any other announcements and press releases from their side I will happily post them as well. But I refuse to go along with the charade that two factions do not exist. Clearly they do. (Notice I describe both as factions, whether that is the best word or not. I don’t refer to the real AIP or the authentic AIP or anything like that.) Just look at any of these threads. Red – There was no counter-protest as only Robinson and Seidenberg appeared. For that reason the police were called for the protection of Chelene. Robinson and Seidenberg told the police that they were gathering evidence at a crime scene. They claimed that we were illegally using the AIP name. Before that Robinson walked down the corridor using a video camera disquised as a pen to film everyone there and then downloaded the information via computer just before the cops arrived.
