The Democratic Party has succeeded in removing the Green Party from the Texas ballot, for now. From My San Antonio:
Gov. Rick Perry’s close friend and former chief of staff tried to help Green Party candidates get on the general election ballot this fall as part of a larger effort by outside groups that state District Judge John Dietz declared “an unauthorized, illegal contribution” Thursday.
The judge granted the Democratic Party a temporary restraining order to block Green Party candidates from being certified for the November ballot.
Democrats contended that a petition drive to put Green candidates on the ballot was actually an effort to help Perry, a Republican, by diverting votes from his Democratic challenger Bill White.
The Green Party, represented by former Republican state Supreme Court Justice Stephen Smith, plans to appeal to the high court on Monday.

Hey, feel free to hate me for any reason, but why you debase yourself with only snarkie remarks? Hate what I say ’bout the (so called) Libertarian Party? Fine!
Think Kubby, Phillies, and W. A. R. are the best thing since sliced bread and not a bunch of lying third raters? Fine.

Of course you DO realize that when you say ANYTHING, sane people roll their eyes.
[a] Independent Green Party of Virginia mole ‘ Green Party Conservative and his knee jerk, brain less response speaks for its self ……….
[b] and Don Lake is consistantly correct and ‘spot on’ per most items! When detractors are called upon to respond with the truth, the varifiable truth, the silence is deafening ………
1. I know Ms Tobin, and the woman is a great american patriot. As was her father.
She is serving our republic and it’s democratic process with courage, and great success.
Tobin is to be praised and applauded.
2. Mr. Knapp is correct. Thank you, Sir for the correct post, and accurate observation.
3. The chances look good that a fair minded Texas Supreme Court will accept the appeal and allow -rightly so – the brave, hard working people of the Texas Green Party to be on the ballot. Bless ’em.
Good article today on The Texas Tribune about the LP candidates who toss the races down here: http://www.texastribune.org/texas-politics/libertarian-party-of-texas/do-libertarians-help-democrats-hurt-republicans/
I have not talked to ONE person on the West Coast whom had a good / pleasant thing to say ’bout Tobin as a political activist and or person.

PEACE
Either sufficient valid signatures were turned in, or not.
If sufficient valid signatures were turned in, then either the Greens go on the ballot or the election and its results are null, void and of no effect due to fraud on the part of the election authority.
If there’s a problem with how the collection of the signatures was financed, that’s an entirely separate issue.
[Saint] Richard Winger and Don Lake have not discussed Ms Tobin’s character and MO [modius oporentdi (sp)] but I have not talked to ONE person on the West Coast whom had a good / pleasant thing to say ’bout Tobin as a political activist and or person.
I take no pleasure ………….
Why are they going to appeal? The Greens told Texas Tribune that they were refusing the signatures. Someone at that party HQ needs to appoint a spokesperson, because the Tribune reported that they are going to refuse the signatures.
This is all going to call into question the Free and Equal/Tobin group, as it should. She was working with money supplied by Republicans that are now vocally linked to Rudy G., and Rick Perry.
I know it’s just their job to collect signatures, but hmm, somewhere there needs to be accountability questions…Free and Equal is nothing more than a handmaiden to GOP money men.
Now one of you rich guys fund a Constitution Party petition drive so that we Texans can get rid of the faux party apparatus of Bryan Malatesta and Daniel New lol.
Upstart Green,
Get on the ballot as Green Party candidate.
That’s the most effective way to make difference.
Run several times. The more you get on the ballot as Green Party candidate the more positive impact you have…
Maybe my Marxist Revolutionary friends are right. You can’t change this system through the ballot box. Its a rigged game.
The obvious question…
How long until the Texas Supreme Court accepts and hears the case.
Then when will they rule in this Green Party of Texas case.
Richard Winger is the unquestioned national expert on Ballot Access matters in our nation.
Thank you for your insight and candor here Mr. Winger.
Despite decades of working on these issues, I really, and truly am shocked, and disappointed once again.
Greens must get back in the saddle in Texas, and across the nation. Get back on the ballot and continue to offer positive solutions, positive alternatives.
The ballot access laws in Texas are ridiculously difficult and are designed to preserve the privileges of the two ruling parties. The laws need to be changed, but of course that won’t happen while the two big parties are in control in Austin. Was there a Republican plot to help the Greens get on the ballot? Yeah, there probably was- but so what? Should the wishes of tens of thousands of qualified voters who signed the petition be denied because of the motivation of the petition funders? If the Democratic Party is so afraid of Green competition at the ballot box then let the Democrats fight for the progressive causes championed by the Greens. Instead, the Dems message to Green voters seems to be “You got to vote for us, cuz we’re the lesser of two evils!”
Probably the money came from a wealthy individual, into the hands of a non-profit ideological 501(c)(3) corporation, and then into the hands of the petitioning company.
Sorry, I meant @7, rw.
Richard, were there any for-profit corporate donations directly to the GP, do you know?
@1: I would hope that there wasn’t a corporate contribution knowingly accepted by the Greens as there’s a party rule prohibiting donations from corporations, or there was when I was in the GP.
This whole thing reminds me of the grief Carl Romanelli went through in Pennsylvania. Since when are people outside a party prohibited from donations or other support, really? At the time the Democrats in Pennsylvania accused Romanelli of “accepting Republican money” the top donors to both the Democrats and the Republicans in Pennsylvania were the same organizations.
The Texas law says corporations can give money to political parties if they are for “normal administrative” expenses. For a minor party, petitioning IS a “normal administrative expense.” The ruling is totally high-handed. The law also says corporations can pay money to parties to help pay for their primaries or conventions. In Texas, the petition is an extension of the convention. The law says convention attendees sign the petition, and if the party had fewer attendees than the number of required signatures, they can keep going by going out on the street. Also, even if the contribution were illegal, it doesn’t follow logically that the party should be removed from the ballot. Texas doesn’t remove major party politicians from the general election ballot, after they won a primary, just because they broke a campaign finance law. This decision will probably be reversed.
Christina Tobin’s Free and Equal ???????
“It put a lot of money in the pockets of Free & Equal and all of the people they hired.”
Well, except for those petitioners that I heard got ripped off.
“LibertarianGirl // Jun 25, 2010 at 11:13 am
bummer , all that work for nothing”
What do you mean for nothing? It put a lot of money in the pockets of Free & Equal and all of the people they hired.
Hopefully the appeal will work.
bummer , all that work for nothing
No matter how many studies and election results show that Greens and Libertarians don’t draw more from any party, the Republicrats continue to use them as leverage against each other like children in a nasty divorce.
Judge Dietz, even if you think it’s not fair to the Democrats to have the Greens on the ballot, there is often a difference between what is right and what is fair. The Greens worked within the law to get themselves on the ballot, so they deserve to be there. To suggest that they can’t accept “outside help” requires ignoring the First Amendment. You are no longer deserving of the title, “your honor.” You are a disgrace to the American judicial system.
