Alabama Secretary of State Rejects Constitution Party’s Special Election Petition

Alabama has rejected the Constitution Party’s ballot access petition for the special election, State House, 31st district. See this story in the Birmingham News. Because the Republican Party is the only party that qualified a candidate for this election (no independent ran, no Democrat ran, and the Constitution Party failed to get on the ballot) the special election is now cancelled and the Republican nominee is deemed elected.

The Constitution Party expected to get a report of its petition validity before the deadline, but reversing past practice, in this case the Secretary of State refused to check any signatures until the deadline had passed.

Two party rule is only one party away from a one party dictatorship. Constitution Party of Alabama, pray yes, but raise some hell also.

It looks like they should have hired the pros who got them on the ballot in Alabama in 2008 and in 2012, the ones that they still owe money from 2012.

Unfortunately no case. Sampling is perfectly valid, as elementary college level (used to be high school) statistics demonstrates, or for those who have actually checked validity on large numbers of signatures, experience.
But when you have no case you can always offer to pray for the other person, [….oooooooooooooookay….]

I’m doubtful that prayers will improve Alabama ballot access laws. So, if they have a case, I hope they sue.

Constitution Party of Alabama Chairman Joshua Cassity said, ?The state never even looked at the majority of signatures. They decided to do what is called sampling, where they pull a few random pages take the percentage and multiple it by how many you turned it. Unfortunately, the code states they have a choice of which method to use. This leave us little legal ground except to possibly challenge the formula they use. It is almost like they are inviting us to sue, with the possibility of depleting our financial resources. Jeshua was able to speak directly with Secretary of State Jim Bennett and advised him he did not believe we would sue but that he was praying for his salvation and the salvation of everyone in the office and their repentance. Mr. Bennett?s reply was ?OK?.
