Ron Nielson was quoted in an article by Lee Benson of the Salt Lake City, Utah based Deseret News titled “They’re telling us there’s a chance: Could Utah help land Libertarian in White House?” published yesterday, saying:
“it is completely conceivable that a third-party candidate could prevent anyone from winning this election and forcing it to the House, and it’s very conceivable that he could be the candidate that wins in the House. The two (major party campaigns) are so at odds with each other, I mean anyone can see it that it is going to be virtually impossible for either one to vote for the other candidate if it gets into the House. . . . You’ve got two divisive, disliked candidates with gigantic negatives winning their party’s nominations. I would bet Johnson doesn’t have 3 percent negative. People will be looking for a compromise candidate. He’s it. We want people to understand — this could actually happen.”
The entire article can be read HERE.
(The Salt Lake Tribune also ran an article about Gary Johnson’s campaign yesterday, this one titled, “Libertarian Gary Johnson’s comments on religious freedom and Mormons may hurt in Utah” with the photo caption “Libertarian candidate issues apology for his “imprecise” reference to Mormon history.” That article can be read HERE.)
When no candidate has a majority in the US Electoral College, then under the 12th Amendment to the US Constitution “the votes shall be taken by states, the representation from each state having one vote.”
An analysis of the makeup of the US House delegations from BALLOTPEDIA indicates that 33 states have Republican majorities among their Representatives, 14 have Democratic majorities, and 3 are tied (see below) — a seeming clear majority for the Republican candidate should a Third Party candidate win enough electoral college votes that neither of the old parties’ candidates have a majority in the electoral college, and the election for President of the United States actually go to the US House.
The following states have Democratic majorities in the US House: Washington, Oregon,
California, New Mexico, Minnesota, Illinois, Hawaii, New York, Rhode Island, Maryland,
Vermont, Massachusetts, Connecticut, and Delaware.
The following have Republican majorities: Idaho, Nevada, Utah, Arizona, Montana, Wyoming, Colorado, North Dakota, South Dakota, Nebraska, Kansas, Oklahoma, Texas , Iowa, Missouri, Arkansas, Louisiana, Wisconsin, Alaska, Kentucky, Tennessee, Mississippi, Michigan, Indiana, Alabama, Florida, Ohio, Georgia, West Virginia, Virginia, North Carolina, South Carolina, and Pennsylvania,
These states have equal numbers of Republican and Democratic Representatives in their delegations to the US House: New Jersey (6 each), New Hampshire (1 each) and Maine (1 each).

RC:” But then couldn’t the Ds do the same?” Oh, absolutely, but the important point is that there will be three candidates before the house, and none of them will be a Libertarian.

And, it’s not the only debate Badnarik is trying to get into. The Libertarian Party, on the ballot in all 50 states for the past three elections, the nation’s third largest political…

Cornell Presidential Debate
Oct 27, 2004
GodFamilyRepublic.com movies
On October 6, Four Presidential Candidates gathered to have a most unusual debate. It was one where issues were debated and actual questions were asked! You must know then, that Bush & Kerry did not participate in this debate. They were getting prepped for their Presidential Press Conference. Find out who else is running – and why we can’t afford to waste our votes this – or any other time – on empty promises. Badnarik, Brown, Cobb, Peroutka. This is an unrated, unedited, uncut, raw feed…
Interesting: Johnson is over the 1m landmark on Facebook.
gp: there is nothing to keep the Republicans from arranging things so that, say, Ted Cruz gets four Texas electoral votes, so the choices in the house become Clinton-Trump-Cruz.
me: Kinda like selling a covered call or something. But then couldn’t the Ds do the same?
as they sorta say in Animal Farm… some posters are more equal then others…. here at IPR
Dave,
I have that same problem…. and yet I notice others can post much longer posts then I.
Forgive me having to post the above in three parts, but my posting keeps timing out when I try to post too much at once on this site. Very frustrating.
Though interestingly enough, Badnarik himself is quoted as saying immediately upon his wining of the nomination, “If I can win the nomination, there’s no reason I can’t win this election.” Highly doubtful he really believed it, but I don’t fault him for it. My point is campaigns always declare they can win. It gets their supporters riled up. No one wants to believe a candidate they really like, may donate to, and may volunteer for will get .3-.6% of the vote on election day.
Maybe not the campaign itself, but I do remember that being harbored as a big game changer for the campaign. In fairness, I don’t recall anyone from the campaign coming out and declaring this would win Badnarik the election, though many of his fans thought getting him mainstream media coverage would prevail him to victory. But best I recall, he never did get on O’Reilly or attacted major press, so I suppose we’ll never know.
The blog has since apparently been lost to history, as the Badnarik campaign site has gone over to internet heaven. But I was able to find a reference to it from a post on an election forum.
“(Badnarik’s) next big move is to hire a reputable PR firm in New York that would be able to get him on shows like Larry King Live, Real Time w/ Bill Maher, The O’Reilly Factor, The Daily Show w/ Jon Stewart, etc., though he needs a few thousand more dollars according to his blog.”

I followed the Badnarik campaign for President, and I do not recall them putting out any statement that was this delusional.
Five Problems With Johnson/Weld (for Republicans) – http://townhall.com/tipsheet/guybenson/2016/08/02/here-we-go-republicans-for-johnsonweld-launches-n2201084
I’ve noticed that many of the Gary Groupies love to tout this ticket as being more “serious” and “credible” than past LP tickets, or even than the major party tickets.
So, do you guys think this Constitutional sleight of hand is a “serious” and “credible” theory to promote?
It’s ridiculous of course, but I seem to recall the Badnarik campaign building the same hype back in 2004. It was the first LP campaign I really followed, and there were several weeks where excitement hit a critical level because the campaign had gotten some PR agency that was going to get them on the O’Reiley Factor and other popular shows. From there a lot of his supporters seemed convinced that as soon as all Americans knew who he was, he’d win in a landslide(granted, I was one of them.)
I don’t fault the Johnson campaign for trying to build enthusiasm.
The problem with this theory is that the U.S. population, docile though it is sometimes, would not stand for the U.S. House of Representatives to choose the person who came in a distant third in the popular vote to be President.
Even in 1824, when the U.S. House chose the person who placed 2nd in the popular vote instead of the person who placed first, the public was very upset.
The requirements for this scenario are (i) a third-party candidate gets electoral votes, (ii) none of the other three candidates has a majority of the electoral votes, (iii) party loyalty does not elect Trump. (ii) is extremely difficult to arrange. If the other two candidates are more than five electoral votes apart, one of them wins.
In addition to that, the orthodox Republican an Democratic folks have to fail to notice that they control who are the three candidates in the house. If, for example, Trump and Clinton split perfectly, and Stein gets her three electoral votes, so that the election is House–bound, there is nothing to keep the Republicans from arranging things so that, say, Ted Cruz gets four Texas electoral votes, so the choices in the house become Clinton-Trump-Cruz.
Yeah, right. Keep on passing that crack pipe around and maybe you will get more people to believe this.
