The Libertarian Party of Travis County in Texas is calling for the impeachment of President Donald Trump, citing alleged constitutional violations and the administration’s handling of due process for U.S. residents.
In a resolution adopted Monday during the party’s monthly meeting, the affiliate formally called for Trump’s impeachment. The resolution claims the Trump administration violated constitutional rights by denying due process to legal residents, targeting individuals for deportation based on political beliefs, and issuing executive orders that the party argues are otherwise unlawful. It also raises concerns over past remarks from the president suggesting that American citizens could be sent to foreign prisons.
The resolution specifically highlights the recent case of Kilmar Abrego Garcia, a Salvadoran national residing in Maryland, who was reportedly deported in error to El Salvador. The Trump administration has stated that Garcia was affiliated with MS-13, a gang designated by the U.S. government as a terrorist organization. Garcia and his legal team dispute this claim, and no related criminal charges have been filed. Despite a unanimous U.S. Supreme Court ruling affirming Garcia’s right to remain in the United States, the administration has said it lacks the authority to force his return.
Declaring that the administration has “no obvious intention” of honoring the Constitution, the Travis County affiliate argues that impeachment is warranted to uphold the rule of law and the principles of the U.S. Constitution. The full resolution passed by the party can be read below:

On April 14, 2025, the following resolution was passed and will be publicized far and wide:
Whereas, the U. S. District Court for the District of Columbia, affirmed by a unanimous U. S. Supreme Court, ruled that the Government must facilitate Kilmar Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.
Whereas, President Donald J. Trump and members of his administration, admit than an administrative error was made to send Kilmar Abrego Garcia to an El Salvadoran prison, yet say there is nothing they can do about it, when in reality, they choose to do nothing about it.
Whereas, President Donald J. Trump and his administration have violated the constitutional rights of numerous legal U. S. residents by denying them due process of law in challenging deportation orders.
Whereas, President Donald J. Trump and his administration have targeted legal U. S. residents for deportation due to their political viewpoints, in disregard of the First Amendment.
Whereas, President Donald J. Trump has falsely used the Alien Act of 1798 and other laws to effectuate removal of legal residents, when he should have known that these laws involve wartime measures, not law enforcement measures.
Whereas, President Donald J. Trump stated that he wants to send U. S. citizens to foreign prisons where they would certainly have no due process of law.
Whereas, no one in the U. S. appears to be safe from President Donald J. Trump’s lawless, dictatorial pronouncements that he issues as Executive Orders, which he asserts have force of law when they actually violate the constitutional separation of powers.
Whereas, the Libertarian Party stands for upholding the U. S. Constitution and Bill of Rights, and for respecting for the rule of law over dictatorship and tyranny.
And Whereas, President Donald J. Trump took an oath of office to “preserve, protect, and defend the Constitution of the United States” with no obvious intention of doing so.
Therefore, be it resolved, that the Libertarian Party of Travis County calls for the impeachment of President Donald J. Trump and his removal from office.
I rarely agree with the Libertarians on anything but on the matter of Donal Trump I am 110% in agreement with them. This charlatan has to be removed from office before he ruins the country or gets us into a war with Denmark
over Greenland, or with Panama over the Canal Zone–or with Canada, because he just wants to take it over. And
his idea that he can deport individuals to foreign prisons without due process, cancel the writ of Habeas Corpus,
or end birthright citizenship which is in the Constitution is unconstitutional. I question is relationship with Putin.
Is Putin giving him ideas–or pulling his strings? Will poisoning his critics be next? Polonium 210? Thallium?

George – Just FYI – if the President nominates a new Vice-President, the nomination has to be approved by the Senate and the House of Representatives. That gave members of the House the chance to vote against Nelson Rockefeller for V-P in 1974.

It depends. The President can nominate a new Vice President, but Senate ratification is required. That might be a time-consuming process. Ratification might not even happen. If the former VP was looking at impeachment, there might well be a lack of support for letting him choose the new VP.

Unless they were impeached and removed simultaneously, the Speaker of the House will never become president. Under the terms of the 25th Amendment if the President is removed or resigns the Vice President becomes president. He then selects a new vice president who is subject to senate ratification. This has happened in the past when Agnew resigned as Veep and Gerald Ford was selected to replace him. Upon the resignation of Richard Nixon, Ford became president. He in turn selected Nelson Rockefeller to become the new Veep and for a time we had a president and vice president neither of whom were elected to the offices they held. I believe the only way for a Speaker to assume the presidency in this day and age would be in the aftermath of a tragedy.
McArdle frequently slammed Biden. Harlos, Oliver, Bilyeu, Sarwark, Darryl Perry, Waldenberg, etc did not. Chase Oliver openly praised him and Obama many times.
Reason isn’t very libertarian these days. It’s not the publication of 30 years ago.
Chase Oliver was the least libertarian presidential candidate the party has ever run.
To several people: The statement Democrats would be in line if Trump is removed has to be taken in context. Unimportant provided that context in a message that was removed, but not in a subsequent message, which had to be edited more tightly to avoid going off on too many tangents and getting rejected as a result.
Here is the missing context if you will allow it. There is no realistic chance that Trump will be impeached unless and until Democrats take the House in the midterms. Removal is far less likely, and would realistically only happen if Democrats get a supermajority in the Senate, which is very unlikely but not completely impossible. They would then have to impeach and remove both Trump and Vance, in which case the then Democrat speaker of the House would be in line.
Outside of that highly unlikely scenario, another Trump impeachment will result in a Republican, most likely Trump himself, still in office as President. The history of impeachments which did not result in removal against Clinton and Trump indicate that he or Vance would then be more popular and thus more in a position to implement his agenda, and congressional Democrats would then be less popular. How would that help whatever libertarians are trying to bolster with this statement?
Taking seriously for a split second that this Republican led House would impeach this Republican President, and then a Republican majority Senate would remove him – no, none of this will happen – no one in line for the presidency will change the policies which are causing libertarians to call for impeachment here.
To sum it up, what would happen in the case of impeachment is that they will end up with the same policies they don’t like with more momentum behind them, or in a maximum and still very unlikely case two successive removals leading to a Democrat, presumably Hakeem Jeffries, being president no earlier than 2027. Even that would pose quite a few problems from the libertarian policy goals perspective, would it not?
Additionally, while the libertarians certainly criticized Biden, did they ever call for his impeachment? If so, when and where?
‘Rick – various libertarian websites and publications criticized Joe Biden plenty during his runs for office and his time in office. The Cato Institute, Reason Magazone, along with my blog – the California Libertarian Report – carried plenty of critical material on Joe Biden. If you did not read mainstream libertarian publications or webistes, you would have missed these articles about Biden.
If the Libertarian National Committee failed to criticize Bidebn – ask Angela McArdle about that. She was Chair of the LNC during almost 3 years of Biden’s tenure as President. She was too busy sucking up to Trump and RRK Jr to take time to criticize – on substance – Joe Biden, Bernie Sanders or the other left-wing enemies of freedom.
If local Libertarian groups failed to attack Biden, they were either busy protecting themselves from the Caucus and the LNC, or they were run by the Caucus, which was busy running these local groups into the ground. The state chair of the California LP at the time belonged to the Caucus, and I never heard him criticize Joe Biden.

Well, life could become much more complicated. The precedent is Nixon, who resigned in order to avoid a sure-thing trial, being made to stand in the well of the Senate to hear the Sentence being read, let the country get on with its business, and protect his pension and bodyguards.
It seems that Jordan is cracking down more on duopoly-based comments and on comments that give the whiff of personal attacks.
I applaud the latter, and the former is OK within reasonable bounds.

No, Democrats would not be in charge if Trump and Vance were both impeached. Speaker of the House Mike Johnson would be next in line of succession. Let’s please not make elementary-level governmental mistakes.
I am not from Texas but I applaud how you stuck to the facts and made a clear case that the Bill of Rights which applies to everyone was violated. The separation of powers has been eroding. This has resulted in in people being deported to a prison that has no redress, the ending of tpr to places like Sudan where their is a civil war and a famine, and students have lossed their visas for learning how to speak out. We are a country built on protests. Bravo…
Well, one last thing. That gives me another clue as to my potential offense. Indeed, I only discussed Republicans and Democrats only in the context of libertarians, and in particular of this particular statement by libertarians. Were Trump to be removed after an impeachment trial and Vance as well, libertarians wouldn’t be in line for the presidency , Democrats would. It’s also significant which presidents libertarians call for impeaching and which ones they don’t.
While I spent some time comparing Republicans and Democrats as they currently stand, it was only in the context of libertarians hurting themselves nonstop with their positioning relative to those two. Then again, my opinion of what libertarians should do matters to them about as much as their opinion of what the big two should do matters to the latter. I may as well have been talking to myself. Off to other things, hopefully less useless than my attempts to add anything of value to anyone here.

The only part I can think of which you may have misinterpreted as a personal attack were not. I have nothing at all against Mr. Berkman, and the statement was about the view he expressed and not him personally.

I served as Chair of the Travis County Libertarian Party in 1981 and 1982. Proud of them for taking the lead on this topic. I hope more Libertarian groups back impeachment of the Russian stooge who seems to be set on destroying America.
After impeachment. maybe we can deport the Donald to Russia or North Korea so he can live out his retirement among his best friends.
